1. Acceptance of Terms
By purchasing, accessing, or using the Bite IQ Revenue Leak Audit (the "Service"), you ("Customer", "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not purchase or use the Service. These Terms apply to all visitors, users, and customers of the Service, including all individuals authorizing purchases on behalf of a business entity. By completing a purchase, you represent that you have the authority to bind the relevant business entity to these Terms.
2. Description of Service
Bite IQ Revenue Leak Audit is an analytical intelligence product that produces a strategic operational diagnostic in PDF format, delivered electronically within twenty-four (24) hours of payment confirmation. The audit is derived from: (a) publicly available guest review data and operational signals associated with the Customer's business; (b) operator-submitted context: the business segment provided at checkout, and, optionally, a primary operational concern and prior-analysis status provided after purchase; (c) industry benchmarks published by Harvard Business School, the National Restaurant Association, the U.S. Bureau of Labor Statistics, and peer-reviewed academic research. Bite Analytics does not have access to internal financial statements, point-of-sale systems, reservation platforms, payroll data, operational KPIs, or proprietary business records of the audited entity. All figures produced by the Service are modeled estimates based on public signals and benchmarks.
3. Nature of the Output
The Service produces modeled estimates of potential revenue exposure and operational friction. These figures are NOT: verified financial losses, audited accounting results, guaranteed amounts of recoverable revenue, guarantees of business performance, or precise measurements of any kind. All calculations, projections, benchmarks, categorizations, and operational interpretations contained in the audit are directional indicators only. Industry benchmarks may vary significantly depending on geography, market maturity, customer demographics, pricing model, operational structure, concept category, seasonality, and competitive environment. Portions of the audit may be generated, assisted, or enhanced through automated analytical systems, machine-learning models, and probabilistic classification frameworks trained on publicly available datasets. Outputs may contain inaccuracies, omissions, assumptions, or interpretive variations.
4. No Professional Advice
The Service does NOT constitute financial advice, legal advice, tax advice, accounting advice, investment advice, operational consulting, or management consulting. The audit is a strategic diagnostic tool. Any business decision made based on the audit remains the sole responsibility of the Customer. Bite Analytics strongly recommends consulting qualified licensed professionals (financial advisors, attorneys, accountants, operations consultants) before implementing operational, financial, pricing, staffing, legal, or strategic changes based on the audit.
5. Pricing and Payment
Standard pricing for a single Revenue Leak Audit is US$297.00 unless modified by a valid promotion code applied at checkout. Orders billed to a Mexico operating entity are charged MX$5,049.00 in Mexican pesos; the applicable billing market is selected by the Customer at checkout. All payments are processed by Stripe, Inc. Bite Analytics does not directly receive or store credit card information. By completing payment, you also agree to Stripe's terms of service as displayed during checkout. Promotion codes are valid only during their specified period, subject to redemption limits, and may not be combined unless explicitly stated. Promotion codes have no cash value.
6. Delivery
The Service is delivered electronically as a PDF attachment to the email address provided at checkout. Delivery typically occurs within 24 hours of payment confirmation, often within 4 hours. In the event of a technical failure preventing automated delivery within 24 hours, Bite Analytics will deliver the audit manually within a reasonable additional period and notify the Customer. The audit is delivered once. Re-delivery of the same audit is free upon written request. Re-running an audit (with updated public signals) requires a new purchase.
7. Refund Policy
The Guarantee. If the delivered audit does not quantify at least US$15,000 in annualized revenue exposure for the audited property, the Customer is entitled to a full refund upon request within seven (7) calendar days of delivery — no justification required beyond the Audit ID. This is the objective condition advertised on biteiq.ai: the guarantee covers the number, not the novelty of the findings.
Insufficient signal — automatic refund. If the analysis engine determines that the publicly available operational signal for the submitted property is insufficient to produce a defensible audit, the order is aborted, no audit is delivered, and a full refund is issued proactively to the original payment method — no action is required from the Customer, who is notified by email.
Refunds on other grounds. If you believe the audit did not provide meaningful operational, reputational, or commercial insights relevant to your business, you may request a refund within seven (7) calendar days of delivery by contacting intelligence@biteiq.ai with the subject line "Refund Request" and including your Audit ID. Refund eligibility is subject to: (a) good-faith validation of the submitted business information at checkout; (b) confirmation that the audit was successfully delivered; (c) a brief description of why the audit was not meaningful. Refund decisions are made within five (5) business days of receipt. Approved refunds are processed via the original payment method through Stripe and may take 5–10 business days to appear on your statement. Refunds are not available for audits older than 7 days from delivery, audits where false or materially misleading information was provided at checkout, audits where no Audit ID is available for verification, or cases where a refund on a prior audit was previously issued. Bite Analytics reserves the right to deny refund requests in documented cases of system abuse or fraud.
8. Intellectual Property
The Bite IQ Revenue Intelligence System, including its methodology, benchmark calibration, output structure, and analytical framework, is the proprietary intellectual property of Bite Analytics. All rights are reserved. The audit PDF delivered to the Customer is provided for the Customer's internal use only. The Customer may not: (a) reproduce, redistribute, resell, or republish the audit in whole or in part to third parties without written authorization; (b) use the audit to train or fine-tune any machine-learning model or automated analytical system; (c) remove or alter any branding, watermarks, or audit reference identifiers contained in the audit; (d) misrepresent the nature, source, or origin of the audit. The Customer may freely share the audit with internal team members, advisors, or operational partners under the Customer's direction.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Bite Analytics, its affiliates, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the Service, including but not limited to: lost revenue or lost profits, lost business opportunities, operational disruption, reputational harm, data loss, reliance on audit content, or decisions made based on audit content. In all cases, the aggregate liability of Bite Analytics arising from or related to a single audit shall not exceed the amount paid by the Customer for that specific audit. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, the above limitations apply only to the maximum extent permitted by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Bite Analytics, its affiliates, and personnel from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from or in any way connected with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; (d) any business decisions made based on the audit.
11. Prohibited Uses
You may not use the Service: (a) to audit any business or property for which you do not have authorization to receive operational analysis; (b) to harass, defame, or harm any third party; (c) in any manner that violates applicable law; (d) to attempt to reverse-engineer the methodology of the Service; (e) for any unlawful or fraudulent purpose. Bite Analytics reserves the right to refuse service, deny audits, and issue refunds at its sole discretion for purchases that appear to violate this section.
12. Accuracy of Information
You represent that all information provided at checkout (including the business identifier, segment, volume, average spend, primary concern, and contact email) is accurate, current, and complete to the best of your knowledge. Submission of false or materially misleading information may result in audit denial, refund refusal, and account restriction.
13. Changes to the Service
Bite Analytics reserves the right to: (a) modify, suspend, or discontinue the Service at any time with or without notice; (b) update pricing for future purchases (existing purchases are honored at the price paid); (c) refine the analytical framework, methodology, output structure, and segment calibration; (d) update these Terms at any time. Continued use of the Service after publication of updated Terms constitutes acceptance. Material changes to these Terms will be reflected by updating the "Last updated" date at the top of this document.
14. Confidentiality
Information submitted at checkout (email, business identifier, segment, volume, spend, concern) is treated as confidential by Bite Analytics and is used solely to generate, deliver, and support the audit for which it was provided. See the Privacy Policy at biteiq.ai/privacy for full details.
15. Governing Law
These Terms are governed by the laws of México, without regard to conflict-of-law principles. Any dispute arising from or related to these Terms or the Service shall be resolved in the courts of competent jurisdiction in México. The Customer and Bite Analytics waive any objection to venue in such courts.
16. Dispute Resolution
Before initiating any formal legal action, the parties agree to attempt good-faith resolution by direct written communication sent to intelligence@biteiq.ai for a period of thirty (30) calendar days. For disputes under US$10,000 involving an individual customer, either party may elect resolution through small-claims court or binding arbitration administered by a recognized arbitration provider.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
18. No Waiver
The failure of Bite Analytics to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
19. Entire Agreement
These Terms, together with the Privacy Policy at biteiq.ai/privacy and the disclaimer contained within each delivered audit, constitute the entire agreement between you and Bite Analytics regarding the Service.
